1. Legal Compliance & Regulatory Framework
This platform the "Clutch Arena" is operated in strict compliance with the Promotion and Regulation of Online Gaming Act, 2025. Users acknowledge that the App is registered with the National Online eSports Registry and adheres to the guidelines prescribed by the National Gaming Authority.
2. Platform Role: Esports Tournament Organiser
The App acts as the sole Organiser and Facilitator of all eSports competitions. The App is responsible for:
Setting fixed Prize Pools for all modes (1v1, Clash Squad, etc.).
Defining the rules of engagement and match-making criteria.
Ensuring the technical integrity of the competition.
Users agree that they are entering a structured tournament, not a private wager.
3. Classification as a Pure Skill-Based eSports App
The App is classified as an eSports Platform, distinct from "Online Money Games." In accordance with Section 2 of the Gaming Act 2025:
Skill Predominance: Outcomes are determined solely by physical dexterity, mental agility, strategic thinking, and advanced decision-making.
No Wagering: The App does not facilitate betting, wagering, or any "expectation of winning" based on luck or chance.
There are no elements of luck, "loot boxes," or random chance that determine the outcome of a competitive match
4. Skill-Based Certification
Users acknowledge that as an Organiser-led platform, every match is designed to test Skill Dominance.
The Organiser ensures that no "randomized boosters" or "pay-to-win" items are allowed in competitive 1v1 or Clash Squad modes to maintain the Pure Skill status required by Indian Law.
5. Coin System & Virtual Wallet
Top-Up (Entry Credits): Users may purchase "Coins" solely to pay for Tournament Entry Fees or platform-specific digital goods. These coins represent a pre-payment for participation in organized eSports events.
Non-Wagering: Coins cannot be used for "staking," "betting," or "wagering" against other players. All competitions follow a structured tournament format with fixed prize pools.
Withdrawals (Prize Redemption): Only Coins earned as Prizes through verified performance in organized eSports tournaments are eligible for withdrawal into a bank account.
6. Classification of Competitive Modes
All competitive formats, including but not limited to 1v1 Lone Wolf, Clash Squad, and Battle Royale modes, are classified as Skill-Based eSports Micro-Tournaments.
Outcome Determinants: Winners are decided solely by mechanical skill, tactical positioning, map awareness, and reaction time.
Regulatory Stance: These modes are offered in compliance with the National Sports Governance Act, 2025, which recognizes organized digital duels as legitimate athletic competition.
Organized Competition: Participation is restricted to organized tournaments and matches recognized under the National Sports Governance Act, 2025.
7. Eligibility
Age Restriction: Users must be at least 18 years of age (or the age of majority in their jurisdiction).
Mandatory KYC: Users must complete identity verification using government-approved credentials before participating in any competitive tier.
Geographic Restrictions: Access may be restricted in jurisdictions where local laws conflict with central regulations.
8. Fees and Prize Pools
Registration Fees: Users may use "Coins" to pay the Service & Entry Fee for a specific match. A portion of the fee is retained by the Platform as a "Service Fee," and the remainder constitutes the Guaranteed Prize Pool for the winner. No Staking: Users are prohibited from negotiating or setting their own "stakes" against other players. All prize pools are fixed and displayed prior to the start of the match.
Prize Distribution: Prizes are awarded based on performance and rank in a skill-based format. All prize distributions are transparent and reported to the relevant authorities as per the Financial Transparency requirements of the 2025 Act.
No Stakes: Users are prohibited from "staking" money against one another in a manner that constitutes gambling.
9. Prize Withdrawals via UPI
Withdrawal Authorization: Withdrawals are processed only via Verified UPI IDs belonging to the account holder.
Organiser’s Right to Withhold: As the Organiser, the App reserves the right to withhold prize distribution if a player is suspected of violating the National eSports Fair Play Standards.
10. Fair Play & Anti-Cheating
To maintain the integrity of eSports:
The App employs Anti-Cheating as mandated by the 2025 Act.
Any use of bots, hacks, or external software to gain an unfair advantage will result in an immediate permanent ban and forfeiture of any accrued rewards.
Since 1v1 modes have high stakes, the App implements Real-Time Behavioral Analysis:
Any user found "teaming," "throwing matches," or using "Gfx tools/Macros" will have their UPI withdrawal privileges permanently revoked.
In case of a disputed match, the Platform’s automate match-replay system serves as the final authority.
Immediate account suspension.
Forfeiture of all Coins in the wallet.
11. Grievance Redressal

12. Unlawful Use
You agree not to use the website and/or Services for any purpose that is unlawful, illegal, or forbidden by these Terms, or Indian or local laws that might apply to you.
13. Third-Party Links
You agree and acknowledge that the website and the Services may contain links to other third-party websites (such as official WhatsApp or Telegram support channels). On accessing these links, you will be governed by the terms of use, privacy policy, and such other policies of those third-party websites.
14. Contract Enforcement & Withdrawal Rules
You understand that upon initiating a transaction for availing of our Services (registering for a match), you are entering into a legally binding and enforceable contract with us. You can voluntarily cancel your tournament registration for a 100% coin refund up to sixty (60) minutes before the scheduled match start time. Within the final 60 minutes leading to the match, registrations are locked and non-refundable.
15. Force Majeure
Notwithstanding anything contained in these Terms, the parties shall not be liable for any failure to perform an obligation under these Terms if performance is prevented or delayed by a force majeure event.
16. Governing Law
These Terms and any dispute or claim relating to them, or their enforceability, shall be governed by and construed in accordance with the laws of India.
17. Jurisdiction & Disputes
All disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Mussoorie, Uttarakhand.
